Guardianship – An Introduction

Everyone ages. It’s an inescapable truth of life. From the moment we are born to the moment we die, we are aging. Some people age with more ease than others, living relatively healthy lives well into their nineties, and some age with more difficulty, developing illnesses, mobility issues, and/or various physical limitations that prevent them from being able to care for themselves on their own any longer.

Here in New York State, we have a law in place – MHL Article 81 – that allows a person who needs help managing their day-to-day living activities (aka their “Activities of Daily Living”) and/or their financial affairs to get a court appointed Guardian. This Guardian can have as many or as few powers as are necessary for the individual person’s needs. The Guardian can be appointed at the request of the person who needs a Guardian, or it can be appointed without their consent by the court when the court believes that having a Guardian would best prevent that person from harm.
