An accident in Wheatfield seriously injured two drivers on Sept. 13, and police think one driver was high on drugs when the crash occurred. This driver faces charges for aggravated unlicensed operation 1st degree and driving while ability impaired by drugs.
First responders arrived at the intersection of Errick Road and Niagara Falls Boulevard at about 2:17 p.m., and investigators reported that a Pontiac headed south on the boulevard before it crossed over the double yellow lines and collided with a jeep traveling north. Four people suffered injuries in the crash, and both drivers were airlifted to Erie County Medical Center.
There were two passengers in the jeep when the crash happened, and both received minor injuries. An accident investigation unit is continuing to investigate the wreck, and the driver of the Pontiac may face additional charges.
One individual who lives at the intersection where this collision occurred claims that many accidents have taken place in the area. When this citizen contacted the State Department of Transportation asking them to place a stoplight at the intersection or reduce the speed limit, she was reportedly told that the intersection does not have enough traffic to warrant a stoplight. The DOT also allegedly said they would consider widening part of the boulevard if funding became available.
After suffering injuries in a motor vehicle accident, one may be able to file a personal injury claim in civil court to recover expenses lost due to an accident. Any party who acted negligently and caused one’s injuries might be liable for a crash. While one might seek compensation from a reckless driver, there are also instances where a governing body may face liability for improperly designed or maintained roads.
